To obtain views, comments and feedback from stakeholders and the public regarding the proposed amendments to the statutory patent fee structure under Schedule 1 of the Patents Regulations 1986, as well as the proposed fee incentive mechanism for targeted groups.
2. Memastikan Struktur Fi yang Relevan dan Mampan / To Ensure a Relevant and Sustainable Fee Structure

I would like to suggest that MYIPO consider postponing the proposed patent fee increase for at least three years. With the current economic uncertainties and rising operating costs, many inventors, start-ups, SMEs, universities, and research institutions are already facing financial challenges. Deferring the increase would help keep patent protection affordable, encourage continued innovation, and allow stakeholders more time to adapt before additional costs are introduced.

I welcome MYIPOâs proposal to provide a 20% patent fee discount for the six identified "targeted groups", as it demonstrates a commitment to fostering innovation and making the intellectual property system more accessible.
However, I would respectfully suggest that MYIPO consider increasing the discount to up to 40% and extending the incentive for the first five (5) years of patent protection. While a 20% reduction is beneficial, the overall cost of obtaining and maintaining patent rights, including filing, examination, grant, and annual renewal fees, can still pose a significant challenge for individual inventors, start-ups, micro and small enterprises, universities, and research institutions.
A higher discount over the first five years would be particularly meaningful, as this period is often the most critical stage for technology validation, market entry, fundraising, and commercialization. Many innovators have yet to generate revenue from their inventions during these early years, making cost reduction measures especially valuable for sustaining patent ownership and encouraging continued participation in the patent system.
Furthermore, increasing the discount to 40% would strengthen Malaysiaâs innovation ecosystem by encouraging more domestic patent filings, supporting technology transfer activities, and facilitating the commercialization of locally developed technologies. The long-term economic benefits arising from increased innovation, investment, and knowledge-based growth are likely to outweigh the short-term reduction in fee revenue.
Therefore, I respectfully recommend that MYIPO consider providing a 40% patent fee discount for the six targeted groups for a period of five years from the filing date or until the fifth annual renewal fee, whichever is deemed administratively appropriate. This enhanced support would provide stronger incentives for innovation, improve access to patent protection, and contribute to the development of a more inclusive and innovation-driven economy in Malaysia.

A key justification for increasing fees significantly is to ensure the patent system is efficient and modern, and a cost comparison is made with a number of countries with modern systems. It should also therefore be a requirement that certain old-fashioned practices are brought into line with modern systems of these countries, including abolishing the fees for Authorisation of Agent, downloading a published patent application or granted patent, and agent renewal courses. There should also be an effective refund system for accidental double payments or unutilised official fees.
